CBD Oil and California

Despite California’s reputation as an industry leader in cannabis, the state’s lawmakers have mired CBD producers in red tape. In July 2018, the state’s Department of Public Health issued a statement that essentially prohibited ‘industrial hemp’ and its byproducts, including CBD hemp oil, in any form meant for ingesting. In a contradictory stance, the state law permits CBD tinctures, topicals, drops, and other formats, but only if the CBD oil is derived from marijuana plants (not hemp) and contain less than 0.3% THC. According to the Department’s statement, because this CBD oil would be a marijuana derivative, it would only be legally sold through the state’s recreational marijuana regulatory framework and in licensed marijuana retailers. This highly restrictive policy has meant, in law, a statewide ban on hemp CBD products. 


In practice, however, this is not the reality of California’s hemp CBD market for consumers. Rather, it has forced the state’s growers and cultivators to lag far behind other traditional agriculture states, like Kentucky and Colorado. With market demand as high as it is right now, some farmers estimate the per-acre profit of hemp higher than almonds or grapes, two of California’s biggest agricultural exports. California’s strict legislation has meant that the state’s farmers, many of whom are struggling to maintain their profits as droughts drive water prices up, are unable to take advantage of the economic boon that hemp CBD has been elsewhere.


For a time, it appeared that these antiquated laws would change – in late 2018, Senate Bill 1409 changed the prohibition on growing industrial hemp, but the legislature delayed discussions of legalizing hemp CBD and creating a legal or regulated market for CBD products. Assembly Bill 228 gained momentum following the passing of SB1409, and if passed, would have legalized a market that already exists in California. Unfortunately, the bill died in the Senate Appropriations Committee without a vote and with little public explanation. Some believe that AB228 went too far from the Federal Drug Administration’s (FDA) restrictions, and the legislature refused to cross the line drawn by the FDA.


In the Department of Public Health’s 2018 statement, the state indicated that any change would rely on the FDA, stating “Until the FDA rules that industrial hemp-derived CBD oil and CBD products can be used as a food or California makes a determination that they are safe to use for human and animal consumption, CBD products are not an approved food, food ingredient, food additive, or dietary supplement.” The choice to follow the FDA blindly is odd, considering California’s history as one of the first movers in a cannabis market that is still federally illegal. Nonetheless, California, like many other states, has chosen to defer to the FDA.


What does the FDA say about CBD Oil?

In December of last year, the President signed the 2018 Farm Bill, which included Mitch McConnell’s Hemp Farming Provision. For the hemp industry, the most significant change brought about by the passing of the Farm Bill was the legalization of the production and sale of hemp and its byproducts (CBD oil) and the removal of industrial hemp and hemp CBD from the controlled substances list. This allowed for research on CBD including randomized control trials on human subjects, and a well-regulated market, which would allow for quality control. The reality of the market in the post-Farm Bill world is that regulations on CBD products varies from state to state. Because the Farm Bill removed CBD with less than 0.3% THC from the controlled substances list, it’s no longer under the DEA’s purview. So, federally, it is legal to produce and sell hemp as an agricultural commodity, and while CBD products are no longer an illegal substance, it remains mired in controversial loopholes and gray FDA guidance. 

CBD In Food & Drugs

The FDA today prohibits the sale of CBD foods and CBD supplements, despite the fact that CBD oil is nearly ubiquitous in drug stores across the country, including in major retailers like CVS and Walgreens. Additionally, the FDA has issued no guidance on CBD topicals, CBD pet products, or CBD vape pens. These products, as it turns out, do not necessarily fall under the FDA’s regulatory umbrella, although cosmetics and supplements do. Technically, the medicine Epidiolex, a pharmaceutical prescribed by doctors to children struggling with severe cases of childhood epilepsy, is the only CBD product explicitly authorized by the FDA to be sold to patients across the country. Despite this, the market for CBD oils continues to thrive, outpacing expectations and entering mainstream America at a shocking pace. Although the agency can theoretically pursue legal action against CBD companies, the agency has very limited reach and chooses to do as much good with a small staff as it can – choosing to cite only those companies that market their products using unfounded health claims about the effects of CBD oils. What’s more, the FDA has only issued warning letters to violators and has not yet shuttered any operations.  


While the FDA appeared progressive in a May 2018 letter to the DEA that stated, “CBD and its salts…do not have a significant potential for abuse and could be removed from control under the [Controlled Substances Act] (CSA),” the agency has failed to make progress on the matter since the passing of the Farm Bill.  While discussing the FDA’s decisions on hemp CBD, representatives have recognized the need for a clear national regulatory framework which could allow for purity testing and quality control. However, the agency repeatedly cites a lack of data, research, and published, peer-reviewed scientific studies on RCTs conducted on human subjects studying the effects of CBD oils. Industry stakeholders have also participated in periods of public comments but have complained of the FDA’s slow pace of change.

WHAT IS AUTISM?


Autism is a very complex neurobehavioral disorder that may include impairments in communication skills and social language. These impairments may worsen by frequently rigid and repetitive behaviors.


Autism can be encompassed as an autism spectrum disorder (ASD), as it may manifest itself across a wide array of behaviors from minor to mild to severe, requiring various degrees of support and attention. 


WHAT ARE THE SYMPTOMS OF AUTISM?


Signs and symptoms of autism may vary from person to person. When looking at the often excessive behaviors of individuals with autism, it’s important to recognize that their noncompliance is a reflection of the neurological nature of their disorder, not necessarily willful disobedience.

  • Taking turns in conversations

WHAT IS THE USUAL TREATMENT FOR AUTISM?


The usual treatment for autism may involve medicinal and pharmaceutical modalities. 


Interestingly enough, a study published in 2008 discussed some of the common antipsychotics prescribed for children with autism as well as their associated side effects.


The study concluded that the medications may be able to help alleviate these aggressive behaviors, but also warns of the potential side effects that needed to be heavily weighed and considered. 


HOW CAN CBD HELP AUTISM?


Hemp-derived CBD oil may be a viable and therapeutic option for the treatment of the overwhelming signs and symptoms associated with autism. 


WHAT DOES THE RESEARCH SAY ABOUT CBD & AUTISM?


A study published in 2019 in the Journal of Autism and Developmental Disorders investigated the effects of cannabidiol-rich cannabis in children with autism spectrum disorder. 


After the cannabinoid treatment, 61% of the children showed improvements in behavior, based on ranking from their caregivers.


Also published in 2019, researchers performed a study analyzing the safety and efficacy of medical cannabis treatment in patients with autism. This study included 188 autistic patients who were being treated with medical cannabis from 2015 to 2017. After only 6 months of cannabis treatment (n=155), with 60% being assessed, 30.1% reported a significant improvement in their condition. 


The cannabis treatment appears to be safe and the side effects reported by patients and parents were easy to moderate to cope with. 

WHAT ARE THE BENEFITS OF CBD FOR AUTISM?


CBD, nor any other drug, can remove, cure, or heal core symptoms of autism. However, CBD can help in alleviating disorders often associated with autism, such as anxiety, sleeplessness, and stress. 


For instance, cannabidiol (CBD) may be able to help with sleep cycles and may even assist in lowering anxiety. It may also help with seizure frequency and reduce anxiety, making it easier to learn and develop social communication skills. 


WHAT ARE THE RISKS & SIDE EFFECTS OF CBD FOR AUTISM?


Studies have continued to suggest that it may be safe to administer CBD oil to children with autism. However, there are some potential adverse effects to keep in mind, such as:


  • Vomiting
  • Nausea
  • Lightheadedness
  • Diarrhea
  • Dry mouth
  • Anxiety
  • Drowsiness
  • Psychosis

For most individuals, the potential health benefits outweigh the potential side effects. As with any and all medication, seek advice from your primary physician prior to beginning any CBD regime. 


CAN CBD HELP WITH AGGRESSION CAUSED BY AUTISM?


Individuals living with autism may exhibit aggressive behaviors or irritability.


From what we know so far, there is anecdotal evidence supporting that CBD has been able to enhance their child’s calming techniques, while other parents have reported decreased episodes of violence. 


WHAT DOSAGE OF CBD HELPS WITH AUTISM?

It’s best to start with a lower dosage of CBD and work your way up until you find a comfortable balance of effectiveness with minimal to no associated symptoms. As always, consult a doctor before adding CBD to your routine, especially if you take any other medications or supplements. 

You might also need a higher dosage of CBD if you have strong symptoms you are aiming to lessen or treat, a high metabolism, or greater weight. More on this below. 


CAN YOU OVERDOSE ON CBD?

Since CBD may induce many therapeutic effects and is derived from cannabis, it’s understandable to have concerns about its overdose risk. 

The good news is that the evidence shows there is minimal to no risk of overdosing from CBD. CBD receptors are not found in the brainstem areas that control respiration, meaning that even excessive amounts of CBD do not seem to be able to suppress respiration and result in a CBD overdose, according to the National Cancer Institute.

Clinical human trials and animal studies involving CBD treatment have shown that CBD can be safely and effectively taken at very high levels. Doses of up to 1,500 mg of CBD per day were shown to be well-tolerated. 

However, just because you can’t overdose on CBD doesn’t mean that you can’t take too much CBD. Different people require different amounts of CBD to get the proper therapeutic effects with minimal side effects. Factors that can impact the amount of CBD that is right for you include:

  • Metabolism: A slow metabolism can result in strong CBD effects, while a fast metabolism can make CBD less effective and may require a stronger dose

 

  • Genetics: Your genetics may affect how you experience CBD
  • Weight: Larger body weights often require higher doses of CBD than lower body weights to feel the same effects

 

  • The intensity of your symptoms: Stronger symptoms may require a higher dosage of CBD to be fully effective

Exploring Ways CBD Oil Can Help Cancer Patients

There has been plenty of news surrounding the potential role that CBD hemp oil can play in alleviating the negative side effects of cancer treatment and even possibly treating cancer itself.

And with continued research, the evidence is mounting — despite the continued cloud of controversy that continues to surround the use of CBD hemp oil in the medical field.

Particularly, cannabidiol, also known as CBD oil, is showing incredible promise in the realm of cancer care. CBD is a cannabinoid derived from a hemp plant. It is a powerful antioxidant that has also been linked to neurological protection.

This cannabinoid works naturally with the endocannabinoid system of the body that regulates several bodily functions, including appetite, sleep, immune function, pain and more.  

CBD offers all the medicinal benefits of the cannabis plant, such as hemp without the “high” induced by THC (short for tetrahydrocannabinol, another cannabinoid).

For this reason, the benefits of CBD are among the latest and most promising breakthroughs in the health and wellness field, including in the study of cancer.

While cancer patients may be prescribed psychotropic medication to help with their sleep, CBD cannabidiol oil can provide the same benefits without the chemical side effects. CBD oil has been shown to regulate homeostasis in the body which allows the body to experience more restful sleep. Studies have shown that CBD oil can reduce sleep disruption in cancer patients, making it a great alternative to adding more pharmaceuticals to cancer treatment and alleviating its side effects.

Anxiety and Depression

Being diagnosed with cancer is a highly stressful event as is the treatment process itself. It’s no wonder that cancer patients commonly suffer from anxiety as well as depression.

CBD oil can help reduce anxiety in cancer patients and even boost their overall mental state. It has been shown to provide excellent results in cancer patients when used instead of anti-anxiety and antidepressant drugs, especially when paired with counseling. It takes effect rather quickly in comparison to conventional medication. This means patients can experience the calming and mood elevating effects shortly after taking CBD oil.

CBD hemp oil has already been linked to the alleviation of symptoms from a number of medical and health issues that includes epilepsy, diabetes, and multiple sclerosis. Now, cancer can be added to the mix of diseases that CBD may be able to help alleviate.

Patients are encouraged to consult with their doctors before incorporating a new product into the diet or treatment program. But once CBD is approved to be added, there are plenty of benefits that cancer patients can take advantage of when incorporating CBD oil in their overall cancer treatment.

Creating Seasons Growing Cannabis Indoors

My inspiration for writing this article, creating seasons growing cannabis indoors, was an email I received. A grower asked me why I used a lighting photoperiod of 16/8 (16 hrs. ON/8 hrs. OFF), when I normally vegetate using 18/6, and flower using 12/12 photoperiods. During my reply he had an epiphany, he really “got” my methodology here and how it mimics Mother Nature. His skills just came up—wink.

Today, I want to do the same thing for any of you that don’t get this part of growing cannabis indoors. You have to understand a little bit about how your plants are perceiving things and why. So, I decided to lay it all out here and hopefully it will all come together for you by the end of the article. Let’s roll…

Why Create Seasons Growing Cannabis Indoors?

Okay peeps, here’s the part where we think like plants the best we can. If you were a plant, you would move in uber-slow-motion, so slow, that it is another dimension in which humans cannot see the movement of plants. Only over time can we see that they have grown (moved). Plants are much slower to react to things. Creating seasons is simply keeping them super happy and unconfused—proactively.

Cannabis plants only live (naturally per their genes) for less than a year, that’s their whole lifespan. In that time their main objectives are two-fold, and in two completely different growth modes, wholly.

  1. Grow leaves, stems, and roots rapidly to outcompete other plants, and to assimilate and store nutrients to use for flowering, while they are in vegetative stages of growth.
  2. Create flowers (calyxes, pistils, trichomes) for procreation, and resin, root growth continues, and different ratios of nutrients are sought after. Some leaf and stem growth continues. Stored nutrients are retrieved. All while they are in flowering stages.

Cannabis plants are either in vegetative growth mode, or flowering growth mode. They don’t do both at the same time well. They judge when it’s time to shift modes by their current day/night hours, and if the daylight hours are increasing or decreasing. Indoors we can manipulate that just fine using photoperiods. Plants follow a linear path from youngster, to adult, to mature adult, to flowering adult.

Plants take about 2-weeks to react visibly to photoperiod changes. Remember the stuff I said about how slow motion they are? Okay, so plants really like to prepare for things and know where they stand. For example, they will gauge their container resources once flowering begins to allow them to have enough food to last to the end. Their growth rates will conform. In vegetative mode they are more “risk takers” pushing the limits of their container resources. This is why I always transplant just before starting flowering. The plants have a whole new container to assess. They love that.

So, for my plants to be chugging along at full power with full happiness they need to know “what time of the year it is” according to their photoperiod trend. When plants have 16 hours a day of light, they have more energy to do things than growing under a 12/12 photoperiod. You savvy? Allowing your plants to prepare for seasonal changes allows them to have a much better transition into flowering. Mother Nature doesn’t go from 16 hours of daylight per day to 12 hours overnight. Plants have a lot of time to transition with lots of sunshine power to do it with. Or, in our case here growing cannabis indoors, lots of light power. It’s fine, we got that covered.

What I do is transition my plants slowly through their own seasons by changing my photoperiods more subtly. Now, if you look at your regular outdoor daylight hours around springtime you will see they are actually well below 16/8 and closer to 12/12 actually. Let’s have a look at my lighting schedule next, then I’ll break it down for ya…

  1. Sprouts always get a 12/12 photoperiod for their first 10 days above ground.
  2. After those 10 days I use an 18/6 photoperiod.
  3. About 10 days before flowering, I use a 16/8 photoperiod.
  4. During flowering I use a 12/12 photoperiod, unless I am flowering heirloom/landrace sativas.

Here’s the bennies. Using the 12/12 photoperiod when the plants sprout, they aren’t sure what season it is yet. Once it hits 18/6 the light is increasing (trending upwards) so this makes the plants assume it is indeed springtime and all is well with their world. Not to mention this makes it easier to sex them at 30 days of age.

Photoperiods from Vegetative to Flowering

10-days before flowering time I change their photoperiod to 16/8, and this is before I transplant them. That loss of “daylight” hours for them signals them that fall has come and it’s time to start switching things up to go into flowering mode. Giving them that 16 hours of light, while still signaling them to begin flowering preparations, gives them lots more energy (per day) to make that transition. After those 10 days I transplant them and within a couple of days I switch them to a 12/12 photoperiod.

Creating seasons growing cannabis indoors is massively beneficial to reducing stress, better yields, higher quality, and greater resin production, along with overall plant health/heartiness. What’s not to love?

Signaling your plants flowering time is approaching, along with signaling them as youngsters that it is indeed springtime, will give your plants a level of happiness you will for sure notice huge.

Never, ever, use a photoperiod of 24 hours ON at any stage of growth. If you did a 24/0 photoperiod to sprout them, then put them under an 18/6 photoperiod, they would “think” that fall was approaching, due to the loss of daylight hours, you dig? They would start their lives very confused and stressed that they may have sprouted too late in the year/season. That’s a HUGE problem, if you only live for one season.

I use a standard vegging photoperiod of 18/6 to root cuttings. The only time you would want to use a different photoperiod would be if you were matching up clones for placement outdoors. Because any decrease in your daylight hours will signal the plant that “fall is approaching!” The plants begin switching into a whole new mode to prepare to flower. They use nutrients differently, and they change over to floral priorities. So, if you take a plant out from a cloner or a seedling plant, and have it vegging at an 18/6 photoperiod, and you then place that clone/plant outdoors, even though it’s actually springtime, the diminished daylight hours will signal the shift in the plant’s priorities. This is why you sometimes see plants try to flower when you first place them outdoors from indoors.

To do that indoor seedling plant to outdoor plant thing better you have two choices…

  1. Plant later and place the plant(s) out later in the season, like mid to late June. This is fine, don’t sweat it. Use the 12/12 for first 10 days, then to 15/9 or whatever matches your current daylight hours. Your actual daylight hours outdoors are in fact about 1 hour more than sunrise to sunset.
  2. Sprout at 12/12 and after ten days take them up to 14/10 or something, whatever is about equal to your current daylight hours, then place outdoors earlier in the season. This signals them it is indeed spring and their transition to outdoors will be seamless as the daylight hours continue to increase.

Total darkness during the 10-day pre-flowering 16/8 photoperiod is required here. My vegging area is very dark during lights-out but not totally pitch black like the flowering area. Spectrum changes are also a thing when it comes to flowering, and you want your plants to be prepared if you are changing light spectrums to flower under. The simple solution is just put them under their flowering lights dropped from an 18/6 to a 16/8 photoperiod for 10 days before switching to your flowering photoperiod.

Growing cannabis indoors, clones always work much better in my experience. Seedling plants always do MUCH better outdoors in the ground than clones do. If you are using clones to place outdoors, try placing them outdoors later in the season and you’ll have less of that shift to try to flower for a minute.
